How similar do you think the Wolf device is to Wolf Jardin?
Entec Industries Ltd applied to register a Community Trademark comprising the device of a wolf’s head for “machines for professional and industrial processing of wood and green waste; professional and industrial wood chippers and shredders” in Class 7. Société Emar Wolf owns trademarks for WOLF JARDIN and OUTILS WOLF in France, Spain and Portugal and they filed an opposition based on their earlier rights also in Class 7.
The case went all the way to the General Court. Despite Entec’s wolf being drawn in monochrome and having an aggressive appearance, the friendlier canines were, according to the Court, likely to be damaged by the wolf resulting in erosion of the reputation in these marks and the opposition succeeded.
